¶1None appears on behalf of the applicant to press this application. Sri Pankaj Srivastava, learned AGA for the State is present.

¶2On 18.8.2023, this Court passed the following order: "1. None appear for the parties.

¶2Vide order dated 27-08-2008 proceedings of complaint case no. 5900 of 2007, under Sections 448, 427, 506, 395 IPC, P.S. Nawabganj, District Kanpur Nagar, pending in the court of J.M.M. 10th Kanpur Nagar were stayed by this Court.

¶3Subsequently the opposite party no.2 appeared and filed stay vacation application as well as the counter affidavit on 27-01-2009.

¶4Thereafter, on 10-05-2010 the applicant prayed for filing a rejoinder affidavit. However, till date no rejoinder affidavit has been filed and more than 13 years have passed.

¶5In view thereof, the interim order dated 27-08-2008 is hereby vacated.

¶6List peremptorily on 18-09-2023 in the additional cause list."

¶3Despite the matter being fixed peremptorily for today, none is present on behalf of the applicants to press the instant application. Since the instant case was filed more than 15 years ago, the parties have lost interest in the instant case. Therefore, the instant application is dismissed for want of prosecution.
