¶1Heard Sri Ved Byas Mishra, learned counsel for petitioner and Sri Dhananjay Pratap Singh, learned counsel for respondent.

¶2This writ petition has been filed against the award of the Labour Court, Bareilly dated 17.11.2016 by which the Labour Court has while answering the reference in favour of the workman granted relief of reinstatement with continuity and 25% back-wages.

¶3From perusal of the records, it appears that the respondent-workman had died and as such, question of reinstatement has become infructuous. Sofar as issue of backwages is concerned, petitioner already deposited a sum of Rs.5,00,000/- as directed vide interim order dated 24.05.2017.

¶4In view thereof, the amount which has already been deposited in terms of the interim order dated 24.05.2017, shall be adjusted towards the final payment as directed in the award which impugned the present petition and the same shall be paid to the legal heirs of the deceased respondent-workman within two months from today.
