¶4The FIR of the matter was lodged on 08.06.2023 by the victim herself against the applicant and Sanjay alleging therein that on
08.06.2023 the accused persons called her for reading prayer of Bhagwat and took her on a motorcycle. The applicant also stated of committing rape upon her but she started shout on which people of nearby came there. Police of Dial 112 was called by someone.
¶5Learned counsel for the applicant argued that the applicant has been falsely implicated in the present case. It is argued that the role assigned to the applicant is of taking the victim with co-accused Sanjay on a motorcycle and then standing at guard when co-accused Sanjay was committing rape. It is argued that in the FIR there is no allegation of the applicant committing rape upon her. It is argued that the victim is aged about 23 years as disclosed by her in her statement under Section 161 Cr.P.C. It is argued that the case of the applicant is distinguishable with that of co-accused Sanjay. He further argued that the applicant has no criminal history as stated in para 16 of the affidavit and is in jail since 09.06.2023.
¶6Per contra, learned counsel for the State opposed the prayer for bail.
¶7After having heard learned counsels for the parties and perusing the records, it is evident that no allegation of the applicant committing rape upon the victim. The allegation of committing rape on the victim is on co-accused Sanjay. The case of the applicant is distinguishable with that of co-accused Sanjay.
