Court No. - 40 Case :- CIVIL MISC REVIEW APPLICATION No. - 456 of 2023 Applicant :- Ashok Opposite Party :- State of U.P. and Another Counsel for Applicant :- Ganesh Shanker Srivastava,Ashwini Kumar Counsel for Opposite Party :- C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J.
¶1Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents.
¶2Present review application is preferred with the prayer to recall the order dated 05.05.2016 passed in Civil Misc. Writ Peittion No.59588/2008 (Ashok vs. State of U.P. and another) dismissing the writ petition on merit with detailed observations and further a cost of Rs.10,000/- is imposed upon the petitioner.
¶3As per report of the Stamp Reporter, the review application is filed with delay of 2662 days. A Delay Condonation Application is filed alongwith affidavit but the cause shown in the said affidavit does not inspire confidence of this Court to condone the delay in filing the writ petition.
¶4We have also perused the grounds taken in the review application in question and the order dated 05.05.2016 passed by this Court. It is clearly reflected from the order that has been so passed by the Division Bench that each and every facet of the matter that has been raised, has been examined by this Court and in the garb of review application, rehearing cannot be permitted.
¶5Consequently, in the facts of the case, the review application is dismissed. Order Date :- 24.11.2023 A. Pandey High Court of Judicature at Allahabad
