Case no.
WRIC 30306/2023

Judgment

Court No. - 10 Case :- WRIT - C No. - 30306 of 2023 Petitioner :- Kamal Hasan Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Brijesh Kumar Pandey,Amit Kumar Shrivastava Counsel for Respondent :- C.S.C Hon'ble Kshitij Shailendra,J.

¶1Heard Sri Brijesh Kumar Pandey, learned counsel for the petitioner and the learned Standing Counsel for the State-respondents no.1, 2 and 3.

¶2It is contended by learned counsel for the petitioner that though he has validly passed 10+2 examinations, some person is continuously moving applications before the authorities stating that the certificate issued in favour of the petitioner is fabricated.

¶3This petition has been filed with a prayer that petitioner's application dated 25.07.2023 addressed to the Board be directed to be decided.

¶4The entire frame of the writ petition as well as prayer made therein is thoroughly misconceived.

¶5Neither the name of the complainant has been disclosed in the representation nor does this Court find any justification to issue any direction as sought for as the entire case is merely based upon presumption that the petitioner's certificate would be declared as fabricated by any authority.

¶6Learned counsel for the petitioner submits that on account of pendency of complaint moved by the complainant, he is facing certain difficulties.

¶7Be that as it may, writ jurisdiction has been wrongly invoked.

¶8At this stage, learned counsel for the petitioner seeks withdrawal of the writ petition.

¶9Learned Standing Counsel has no objection to the prayer made.

¶10The writ petition is dismissed as withdrawn.

¶11It is made clear that no liberty has been granted to the petitioner to file a fresh petition on the same cause of action. Order Date :- 24.11.2023 AKShukla/- High Court of Judicature at Allahabad
