¶1The petitioner was allotted plot no.461/462, MIG-1 area 78.04 square meters on 06.10.2001. However, the Authority had not given the possession to the petitioner so far although the petitioner claims to have deposited the entire amount under allotment order. The petitioner had applied for allotment of alternate plot in terms of Clause 29 of the scheme. However, the said request has not been considered.

¶2Prayer made in this instant petition is for a direction to the respondents to allot some other plot to the petitioner in terms of his application dated 30.10.2023.

¶3Sri Mukesh Kumar Singh, learned counsel appearing on behalf of the Development Authority states that the possession of the allotted plot could not be delivered as the said plot was in dispute. He states that the application of the petitioner for allotment of alternate plot will be considered in terms of Clause 29 of the scheme.

¶4Accordingly, the instant petition is disposed of with a direction to respondent no.1 to dispose of the application of the petitioner dated 30.10.2023 within a period of four weeks from the date of communication of the instant order.
