¶1Heard learned counsel for the petitioner and Shri Prinajal Mehrotra, learned counsel for respondent nos.2 and 3.

¶2In pith and substance, the grievance of the petitioner is that the petitioner's father Late Shri Prem Bahadur s/o Shri Shankar Lal died on 25.04.2021. During his lifetime, he has taken a personal loan of Rs.5,20,000/- on the Loan Account No.10897738510. The said loan was insured with Group Loan Insurance Policy issued by State Bank of India, General Insurance with Group Policy No.2333689-000-00 for the period of five years.

¶3Learned counsel for the petitioner states that as the petitioner's father died in the hospital, a death certificate was issued and the same is appended as Annexure no.1 to the writ petition, wherein, it is indicated that he was admitted in the hospital on 25.04.2021 at 11.50 hours and died on the same day at 17.22 hours. Even though cause of death was mentioned as ARDS with suspected Covid-19 but same is refuted by the counsel for petitioner on the ground that petitioner's father died due to Cardiac Arrest. He has confined his prayer that the claim/representation of petitioner dated 15.09.2023 is to be addressed by the competent authority i.e. Branch Manager, State Bank of India, Subhash Nagar, Bareilly-respondent no.3.

¶4Shri Pranjal Mehrotra, learned counsel for respondent nos.2 and 3 states that in case any such application is pending consideration, definitely the same would be decided as per terms and conditions of the Insurance Policy.

¶5Considering the facts and circumstances of the case, no useful purpose would be served in keeping the writ petition pending consideration. The writ petition is disposed of asking the competent authority i.e. Branch Manager, State Bank of India, Subhash Nagar, Bareilly-respondent no.3 to decide the claim/representation of the petitioner within three weeks from the date of production of certified copy of this order.
