¶1Heard learned counsel for the petitioner, learned Standing Counsel for State and perused the record.

¶2This writ petition has been filed for the following relief: "(i) Issue a writ, order or direction, in the nature of mandamus directing the respondent no.3 to convert the land of the petitioner in Khata No.2701, Khasra No.639mi, area .2020 hectare which is situated at Village Begamabad, Tehsil Modinagar, District Ghaziabad from nontransferable land to Transferable land of the petitioner, otherwise the applicant shall suffer irreparable loss and injury."

¶3The preliminary objection has been raised by learned Standing Counsel that the grievance of the petitioner can be taken care of by resorting to the provisions of U.P. Revenue Code, 2006 in view of the judgment dated 27.09.2023, passed by this Court in Public Interest Litigation No. 2117 of 2023(Kanhaiya Lal v. State of U.P. and 14 others).

¶4In view of the above, I am not inclined to interfere in the matter.

¶5In case, the petitioner moves an appropriate application under provisions of U.P. Revenue Code, 2006 for redressal of his grievance, the same shall be considered and decided expeditiously, in accordance with law, after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided that there is no other legal impediment.
