Court No. - 40 Case :- WRIT - C No. - 31412 of 2023 Petitioner :- Akhil Kumar Jain Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Lalit Kumar,Dharmendra Singh Counsel for Respondent :- C.S.C.,K.C. Mishra Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J.
¶1Heard Shri Dharmendra Singh, learned counsel for the petitioner; Shri K.C. Mishra, learned counsel appearing for respondent no. 4 and Shri Ambrish Shukla, learned Additional Chief Standing Counsel for the State-respondents.
¶2Present writ petition has been preferred for quashing the impugned order dated 10.8.2023 passed by the Additional District Magistrate (Judicial), Kaushambi passed in Case No. 1286 of 2022 (Purushuttam & others v. Akhil Kumar Jain & others) and for a direction to respondents not to interfere in the peaceful possession of the petitioner over the property in question.
¶3We have occasion to peruse the record in question as well as the order impugned dated 10.8.2023, whereby after detailed enquiry the authority concerned has recorded categorical finding of fact that the petitioner is having his own property and as such he was not entitled to get any benefit under the Bhoodan Scheme. We do not find any infirmity or illegality in the order impugned so as to make interference under Art.226 of the Constitution of India.
¶4Once the Court has declined to interfere in the matter, learned counsel for the petitioner states that he is not inclined to press the writ petition.
¶5In view of above, the writ petition is dismissed as not pressed. Order Date :- 24.11.2023 Rama Kant High Court of Judicature at Allahabad
