Court No. - 9 Case :- CONTEMPT APPLICATION (CIVIL) No. - 4354 of 2022 Applicant :- Nirmala Shukla Opposite Party :- Dr. Kanchan, Up Ziladhikari Counsel for Applicant :- Ramesh Chandra Shukla Hon'ble Rohit Ranjan Agarwal,J. The writ Court on 06.12.2021 while disposing of Writ - C No.32334 of 2021 passed the following order : "Heard learned counsel for the petitioner, learned Standing Counsel representing State and perused the record. The present writ petition has been filed beseeching the expeditious disposal of case filed by the petitioner for demarcation under Section 24 of the UP Revenue Code, 2006 pending in the court of Upziladhikari (respondent No. 1). It is submitted by the counsel for the petitioner that the petitioner has filed an application dated 25.10.2019 for demarcation of land in question, which is pending protracted and no fruitful steps are being taken by the concerned court for its early disposal despite the fact that statutory period to decide the case, as enshrined under Section 24 (3) of the UP Revenue Code, 2006, has already elapsed. Learned Standing Counsel has no objection in case a direction is issued for early disposal of the case. In this conspectus, as above, no useful purpose would be served to keep this matter pending, therefore, this Court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to Upziladhikari (respondent No. 1), before whom the aforementioned matter is pending disposal, to decide the same expeditiously, preferably, within a period of three months from the date of receipt of a certified copy of this order. It is expected that it should be decided by a reasoned and speaking order, in accordance with law, after affording opportunity of hearing to the parties concerned without granting unnecessary adjournments to either of the parties. With the aforesaid direction, present writ petition is disposed of." A compliance affidavit has been filed wherein it has been stated that the order of the writ Court has been complied with and the proceedings under Section 24 of the U.P. Revenue Code, 2006 has been brought to its logical end on 09.09.2022. As the order of the writ Court has been complied with, the contempt application has rendered infructuous and stands dismissed. Contempt notice stands discharged. Order Date :- 24.11.2023 Kushal High Court of Judicature at Allahabad
