¶1Heard Sri Akhilesh Kumar Ojha, learned counsel for petitioner and Sri Masood Alam, learned Standing counsel appearing for State respondents.

¶2Present petition has been filed seeking following reliefs: "i) Issue a writ, order or direction in the nature of mandamus directing the respondents specially the respondent no. 3 to complete the rest 1/3 Chak Marg no. 1119 situated in Village Sarai Yusuf, Pargana Ghisua, Tehsil Machhalishahr, District-Jaunpur at the place which was demarcated earlier dated 22.07.2019 and 21.06.2023 also by the Lekhpal as well as revenue authorities within stipulated period as fixed by this Hon'ble Court."

¶3Today when the matter has been taken up, learned Standing counsel came up with the specific instructions which is taken on record through which it has been transpired that the proceedings under Section 67 of the U.P. Revenue Code, 2006 has already been initiated against the encroachers and in the said proceedings next date fixed for hearing is 22.12.2023.

¶4In view of the aforesaid facts and circumstances, prayer sought through the instant petition cannot be acceded during pendency of the aforesaid proceeding.
