This petition has been filed seeking a direction to the Civil Judge (Senior Division), Gautam Budh Nagar to decide 6-C2 application filed under Order XXXIX Rule 1, CPC expeditiously, and a further to the defendant-respondents not to interfere in the peaceful possession of the petitioners over the disputed property. It appears that the suit for permanent injunction was filed by the plaintiff-petitioners regarding the suit property. Admittedly, the petitioner has purchased a part of Khasra no.403, Khata No.14 in Village-Hosiyarpur, Sector-51, Noida, Tehsil-Dadri, District Gautam Budh Nagar. The dispute appears to be with a co-tenure holder. The suit was filed on 02.05.2023 and notice on 6-C2 application was directed to be issued. It appears from a perusal of the record that the defendants have put in appearance. The trial court has also issued a commission for calling upon the court bailiff to make an inspection of the suit property.
