¶1The case of the writ petitioner as worded in the writ petition is that he claims himself to be the Principal, Jainmati Ujagarmal Jain Inter College Kavi Nagar, Ghaziabad which is claimed to be a minority institution. According to the writ petitioner, there was certain audit objections regarding appointment beyond the sanctioned strength. The matter is stated to have been reported to the Educational Authorities. The writ petitioner claims that the third respondent is usurping the post in question.

¶2Prayer in the present petition is for a direction to the District Inspector of Schools, Ghaziabad to take appropriate decision upon the audit report dated 31.12.2018.

¶3Sri P.K. Shahi, learned Additional Chief Standing Counsel who appears for the official respondents submits that ordinarily the writ petition at the instance of the Principal would not be maintainable since there is an audit report dated 31.12.2018, thus, a conscious decision is taken by the second respondent, District Inspector of Schools, Ghaziabad. He further submits that he does not propose to file any response to the writ petition.

¶4Considering the submission of Sri P.K. Shahi, learned Additional Chief Standing Counsel, the writ petition stands disposed of requiring the second respondent, District Inspector of Schools, Ghaziabad to do the needful in accordance with law after putting to notice the affected parties within a reasonable time as contemplated under the statute.
