Judgment

Court No. - 34 Case :- WRIT - A No. - 19585 of 2023 Petitioner :- Vikas Yadav Respondent :- Union Of India And 8 Others Counsel for Petitioner :- Sanjay Pathak,Rakesh Kumar Counsel for Respondent :- A.S.G.I. Hon'ble Ajit Kumar,J. Petitioner is a candidate for the post of Constable (G.D.) in the selection held in the year 2018, however, on account of some inquiry pending regarding thumb impression, identification and handwriting expert opinion that the respondents have not proceeded to finalize the result of selection, even though the result stood declared on 21.01.2021. Ms. Neeru Devi, learned counsel representing respondent nos. 1 to 9 submits that the reports are still awaited and until and unless these reports are obtained, no final decision can be taken in the matter. In the considered view of the Court, no specific direction can be issued tot he selecting body to conclude the process in a time bound period when it becomes an issue to question the selection itself by the Selection body but being a public body it is expected that it will be doing the needful in reasonable time and therefore it is expected that the respondents till be concluding the matter as soon as the report is obtained without any undue delay within a reasonable period to say two months of the submission of technical report before it and in any case by 31st March 2024. However, it is provided that petitioner since is a selected candidate in the select list published on 21.01.2021 any adverse order as to his candidature would be passed only in compliance of principles of natural justice in the light of the law laid down by this Court in Ran Vijay Singh & 34 Others v. Union of India & Others, Writ - A No. 2813 of 2017. With these observations and directions, this petition stands disposed of.
