Judgment
Court No. - 46 Case :- WRIT - C No. - 40848 of 2023 Petitioner :- Smt. Neelam Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Gautam Kumar Banerji,Snehlata Sharma Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Syed Aftab Husain Rizvi,J. This is utterly a misconceived petition. The petitioner claims to be a poor lady and has approached this Court with the grievance that a higher compensation was liable to be paid to her which has been denied. Learned State Counsel points out that, in fact, petitioner has entered into an agreement with the State for transfer of her land and that a transfer deed has also been executed in favour of the P.W.D. Department of the State. The sale-deed has been annexed along with the writ petition. There is no challenge to the sale-deed nor can there be a challenge to it directly in a writ petition. Once the petitioner has already agreed to accept sale consideration and has executed the sale-deed, any subsequent claim for payment of higher compensation is utterly misconceived. Accordingly, the writ petition is dismissed. Order Date :- 28.11.2023 SP/- High Court of Judicature at Allahabad
