The instant application under Section 482 Cr.P.C. has been preferred by the applicants, namely, Gaurav, Smt. Indrawati, Indrajeet Singh, Sonu Thakur and Smt. Anupam, with a prayer to quash the the impugned order dated 05.08.2022 passed by learned Civil Judge (J.D.)/ Judicial Magistrate, Fast Track Court, Court No.3, Bulandshahr in Criminal Misc. Case No.2092 of 2021 (Smt. Sushma Vs. Gaurav and Others), under Section 12 of ptotection of Women from Domestic Violence Act,2005, Police Station-Kotwali Nagar, District-Bulandshahr. Vide order dated 05.08.2022, notice has been issued to the applicants to appear in the aforesaid proceedings. At the outset, learned counsel for the applicants submits that applicants do not want to press this application at this stage. Therefore, they may be allowed to withdraw this application with liberty to pursue their case before the concerned Court below. Learned A.G.A. for the State has no objection to such prayer of the applicants. In view of the statement made by Shri Shyam Babu Vaish, learned counsel for the applicants at the bar, the instant application is dismissed as not pressed with liberty as prayed.
