Judgment

Court No. - 2 Case :- TRANSFER APPLICATION (CIVIL) No. - 885 of 2023 Applicant :- Amit Kumar Kannaujiya Opposite Party :- Snehlata Counsel for Applicant :- Shitlesh Pandey Hon'ble Saral Srivastava,J.

¶1Heard learned counsel for the applicant.

¶2The present application has been filed by the applicant-wife seeking transfer of Case No.384 of 2017 (Amit Kumar Kannaujiya Vs. Snehlata), under Section 13 of Hindu Marriage Act pending in the court of Additional Principal Judge, Family Court No.2, Azamgarh to court of Principal Judge, Family Court, Mau.

¶3The only ground on which transfer of aforesaid case is sought is that father of the opposite party is a leader of ruling party and he is influencing the court and not allowing the court to proceed with the matter.

¶4Be that as it may, this Court is not inclined to interfere with the transfer application inasmuch as the ground on which transfer of case is sought is not made out from the records. Even there is no pleading in the transfer application as to what post father of opposite party is holding in the ruling party, and how he is influencing the court, therefore, the allegations are not made out from the record.

¶5In such view of the fact, the transfer application lacks merit and is hereby dismissed with no order as to costs. Order Date :- 28.11.2023 Sattyarth High Court of Judicature at Allahabad
