1.Instruction dated 27.11.2023 has been placed by Mr. Govind Kumar Saxena, learned Additional Chief Standing Counsel for the State-respondents before this Court, which is taken on record.

¶2The instant P.I.L. has been filed for the following relief: "(i) issue a writ order or direction in the nature of mandamus commanding/ directing the respondent Nos. 2 and 3 (District Magistrate/Sub Divisional Magistrate, Tehsil-Sadar, District-Basti) to stop the construction work of Boring/Digging of Water Tank (Pani Ki Tanki) which constructed in Khalihan of Khata No.00174 of Arazi No.960 (Ara 0.1260 Hectare) situated at Gram/ Village Panchayat-Raksa, Sodhari Tappa Kapri Sason, Pargana-Mahuli Paschim, Post office-Samasapur, Police Station-Lalganj, Tehsil-Sadar, District-Basti, otherwise the surrounding public at large and the petitioner shall suffer for irreparable loss and injury."

¶3Mr. Govind Kumar Saxena, learned Additional Chief Standing Counsel for the State-respondents on the basis of the instruction submitted that plot No.96-ka area 0.0920 hectare is recorded as naveen parti in the revenue record, which has been proposed for the construction of the water tank under the Government Scheme. He further submitted that plot No.96-kha area 0.126 hectare is recorded as khalihan, which is vacant and there is no proposal for construction of water tank in respect to plot No.96-kha.

4.Mr. Sanjay Kuma om, learned counsel for respondent No.5 also submitted that from perusal of the revenue record, it is very much established that plot No.96-ka area 0.0920 hectare is recorded as naveen party and plot No.96-kha area 0.126 hectare is recorded as Khalihan and there is no proposal of construction of water tank in plot No. 96-kha as such averment made in the writ petition that authorities be restrained from constructing the water tank over plot No.96-kha khalihan land is misconceived. He further submitted that proposal has been made for construction of water tank in respect to the plot No.96-ka which is recorded as naveen parti.

¶5I have considered the argument advanced by the learned counsel for the parties and perused the record.

¶6There is no dispute about the fact that plot No.96-ka is recorded as naveen parti and plot No.96-kha is recorded as khalihan in the revenue record.

¶7Perusal of the instruction of Tehsidar, Sadar, Basti dated
