¶1Learned counsel for the applicant as well as learned AGA for the State are present.

¶2Instant application under Section 439 (2) Cr.P.C. has been moved by the applicant for cancelling the bail granted to the opposite party No. 3 by learned Additional Sessions Judge in case crime No. 296 of 2023 under Sections 452, 323, 324, 427, 307, 504, 506 I.P.C.

¶3Learned counsel for the applicant wants to withdraw the instant application for cancellation of bail with a liberty to file a fresh application for cancellation of bail before the court below.
