¶3Learned counsel for the applicant submits that applicant has been falsely implicated in the present case just to harass the applicant in fact no such incident has taken place as alleged in the impugned FIR. The applicant has never committed any offence as alleged in the impugned FIR. Initially, an FIR was lodged against the applicant in which final report was submitted before the court below. Being aggrieved, the informant filed protest petition upon which the applicant was summoned and subsequently cognizance has been taken to face trial under the above mentioned sections. Being dissatisfied, the applicant and his brother co-accused Shiv Raj Singh has filed Criminal Misc. Application u/s 482 Cr.P.C. Against the aforesaid orders, Writ-C No. 4968 of 2014 has been filed before this Court wherein this Court has invited a counter affidavit but no interim relief has been granted. He further submits that the Magistrate, however, going by the protest and looking to the statements of the informant and his wife alone have summoned the applicant. The statements of the informant and his wife are nothing but bald allegations without any tangible evidence to support the prosecution case of trespass, extortion, cheating and realization of Goonda tax in the sum of Rs. 5 lacs about which there is no evidence in the case diary. He further submits that the parties have entered into compromise and on the basis of compromise, the said suit was decided.
