Considering the facts and circumstances of the case and without expressing any opinion on the merits of the case, this application under section 483 Cr.P.C. is finally disposed off with a direction to the Additional Chief Judicial Magistrate, Court No.2, Muzaffar Nagar to decide the Complaint Case No. 1403/9 of 2015 (Sanjay Kumar Pundir Vs. Neeraj Kumar & Others) under section 420 IPC, P.S. Charthawal, District Muzaffar Nagar in accordance with law after ensuring the presence of accused by taking appropriate measures without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of one year from the date of production of certified copy of this order, if there is no legal impediment.
