Judgment
Court No. - 93 Case :- APPLICATION U/S 482 No. - 35754 of 2023 Applicant :- Ramesh Opposite Party :- State Of U.P. And 8 Others Counsel for Applicant :- Krishna Chandra Pandey Counsel for Opposite Party :- G.A.,Man Mohan Singh Hon'ble Manoj Bajaj,J. Complainant-petitioner has invoked the inherent powers of this Court under Section 482 Cr.P.C. seeking directions to the trial court for concluding the trial in Sessions Trial No. 622 of 2022 (State vs. Krishna Kumar Singh @ Kallu & others) arising out of Case Crime No. 120 of 2022 registered under Sections 147, 148, 149, 307, 504, 302, 34 IPC, Police Station Vindhyachal, District Mirzapur, in a specific time schedule. Learned counsel submits that on the basis of a written complaint by complainant, subject FIR was registered against the accused person and after completion of investigation, final report was filed, but the trial of the said case is not making any headway as the accused are taking unnecessary adjournments. He prays that a necessary direction be issued for concluding the above trial in a specific time frame. During the course of hearing, it is not disputed by the learned counsel that after examining the record of the case, the charges against the accused were framed on 23rd August, 2023. There is nothing on record to indicate that firstly for which date the case was fixed for producing prosecution evidence. The petition has been filed after few days of framing of the charges, i.e. 11th September, 2023 and in this brief period, no material much less attributing delay to the accused is pointed out. Thus, considering the nature of the offences, trial and the fact that it has recently commenced, this Court is not inclined to issue any direction as prayed for. This application is dismissed.
