The present petition under Article 227 of the Constitution of India, has been filed, with a prayer to direct the learned Trial Court i.e. learned Civil Judege (Junior Division), East, Prayagraj to decide the (6C) Application dated 18.09.2023 filed by the plaintiff/applicant in Original Suit No. 3472 of 2023 (Lal Bahadur vs. Mahendra Singh and others) with a further prayer not to alienate or change the nature of land and dispossess the plaintiff/applicant till the disposal or original suit no. 3472 of 2023 from Arazi No. 2059 situated in Village Nedula, Pargana Mah, Tehsil Handia, District Prayagraj. The order sheet of the case which has been appended along with the petition, indicates that the trial court, on 19.09.2023 directed for issuance of notice fixing 19.10.2023 as the next date. There is no material on record as to the subsequent developments. Moreover, the Trial Court being seized with the matter, it is not a fit case where the direction sought for by the petitioner, can be granted.
