¶1Heard Sri Sudhir Kumar, learned counsel for the appellant and learned AGA for the State.

¶2Vide order dated 07.02.2019, the appeal has already been abated against the appellant nos.1 / Mulaim Singh and appellant no. 2 / Munshi.

¶3As per office report dated 24.11.2023, the appellant no. 3 has died. A report has been submitted by Chief Judicial Magistrate, Bareilly in this regard which is on record.

¶4No application has been moved on behalf of the legal heirs of appellant no. 3 / deceased to pursue this appeal further.

¶5In view of the aforesaid, the instant appeal is dismissed as abated.
