¶1Heard learned counsel for the applicant and learned A.G.A. for the State.

¶2By means of the present application under Section 483 Cr.P.C., the applicant has sought for a suitable direction to the court concerned to decide the Case No. 823 of 2021 (Jyoti Pandey Vs. Pawan Upadhyay and others) under Section 12 of Protection of Women from Domestic Violence Act 2005, Police Station Sindhora, District Varanasi pending before learned Additional Chief Judicial Magistrate-VIII, Varanasi within time stipulated by this Court.

¶3The perusal of the order sheet reveals that on earlier occasion dated 10.10.2023, the case has been proceeded ex-parte against opposite party and is fixed for ex-parte evidence on behalf of the appellant.

¶4The appellant may produce ex-parte evidence in his favour.

¶5No useful purpose would be served in keeping the application pending, which is finally disposed off with a direction to the court concerned to consider and decide the aforesaid case expeditiously, in accordance with law, preferably within a period of six months from the date of presentation of certified copy of this order, provided there is no other legal impediment.
