Petitioner is aggrieved by a notice issued by Nagar Nigam Aligarh, dated 6.11.2023; whereby he has been called upon to submit his reply or else the contract awarded to petitioner would be cancelled. The show cause notice is challenged on various grounds. Counsel for the respondent, however, submits that an opportunity has already been given to petitioner, which has not been availed so far. Records reveal that petitioner has requested for 21 days time to submit a reply. In the facts of the case we permit the petitioner to submit his reply to the show cause notice within a week from today, annexing all materials in support of his claim. All objections, as are being raised before this Court would be open to be raised before the concerned authority, who shall take appropriate decision before proceeding any further in the matter.
