Counsel for parties are in agreement that Appellate Authority has not decided the appeal in terms of judgment passed by Division Bench of this Court in Ram Prakash Vs. Deputy Director of Consolidation, Hardoi and Others, 2022 (2) AWC 1345 (LB) and the same error has been committed by Deputy Director of Consolidation also. In view of above orders passed by Appellate Authority as well as Deputy Director of Consolidation are set aside and matter is remitted back to Appellate Authority to decide appeal, taking note of judgment Ram Prakash(supra), afresh, preferably within a period of three months from today, if there is no legal impediment.
