Petitioner nos. 1 to 139 are working in district Aligarh on the post of Constable in Civil Police and therefore, common writ petition at their instance for the relief of re-fixation of pay w.e.f. 01.01.2016 under the recommendation of the 7th Pay Commission for which the effective order is to be passed by respondent no. 4, is now being entertained, whereas, in respect of remaining other petitioners, liberty rests with those petitioners to file a petition afresh before this Court and, therefore, this petition is permitted to be withdrawn and is according dismissed as withdrawn in their respect. Now the petitioner nos. 1 to 139 since have claimed for pay fixation from a prior date in point of time than from what exactly they have been conferred upon with under the recommendations of 7th Pay Commission, they seek appropriate direction. Learned Standing Counsel submits that the matter at the first instance is required to be examined by the respondent no. 4. In view of the above, it is hereby provided that the petitioners would be making representation afresh before the respondent no. 4 within a period of four weeks along with the certified copy of this order ventilating all their grievances and upon such representation being made, as directed herein above, the 4th respondent shall be passing appropriate order as expeditiously as possible preferably within a further period of two months and in the event petitioners are held entitled for the relief as claimed for, the same shall be given to them without any further delay within the next 30 days' time.
