¶1The petitioner was awarded a contract by respondent no.3. In connection therewith, the petitioner had deposited 2,03,000/- as security money. According to the petitioner, he has completed the work satisfactorily, but the security amount has not been returned to him.

¶2Learned counsel for the petitioner places reliance on a communication dated 30.11.2022 by respondent no.2 addressed to District Magistrate, Mathura stating that the security amount was deposited by the petitioner in town fund account of Nagar Panchayat and it was spent by Nagar Panchayat in maintenance of Gaushalas. It is also mentioned in the letter that currently the Nagar Panchayat was not having any money with it. As soon as money is received in the said account, the security amount would be refunded.

¶3Counsel for the petitioner submits that although one year has passed since then, but payment has still not been made.

¶4In the circumstances, we direct respondent no.3 to refund the security money within thirty days from the date of communication of the instant order, failing which, he will pass a speaking order disclosing why payment has not been made.
