Court No. - 6 Case :- WRIT - C No. - 33810 of 2023 Petitioner :- Rajesh Kumar Chaubey Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Ram Autar Verma Counsel for Respondent :- CSC,Kunal Ravi Singh Hon'ble Mrs. Manju Rani Chauhan,J. This petition has been filed with a prayer to quash an order dated 17.02.2023 passed by the State Information Commissioner, Uttar Pradesh and to direct respondents especially the District Development Officer, Jaunpur / respondent no. 4 and District Programme Officer, Bal Vikas, Jaunpur / respondent no. 5 to provide the petitioner information on point no. 3 of his RTI application, and further to punish the officers concerned to give incorrect, incomplete and misleading information. Learned counsel for the petitioner submits that he requested for information on three points, as detailed on Page-120 of the writ petition, however, incomplete information has been provided as the information, as required on the said points, has not been given to him. He further submits that the information has been provided with some delay, therefore, the concerned officers are required to be punished in view of the provisions of the Right to information Act, 2005. On the other hand, learned counsel for the respondent no. 2 submits that the information, as sought by the petitioner, has already been provided to him as is evident from a perusal of Page-125 of the writ petition. Even otherwise, he is not aggrieved, in any way, by the order dated 17.02.2023 as it has already been stated in the said order that in case the petitioner has any objection he may file same within two weeks, however, without availing the remedy as provided by the order impugned, the petitioner has approached this Court. Insofar as the punishment to responsible officers sought to be inflicted upon, the petitioner has no locus to request for the same before this Court. In view of the above, the writ petition stands disposed of. The petitioner may file objections, if any, in compliance of the order dated 17.02.2023, which shall be decided by the authority concerned as expeditiously as possible in accordance with law. No order as to costs. Order Date :- 29.11.2023 DS High Court of Judicature at Allahabad
