¶1Heard learned counsel for the parties.

¶2By means of this petition filed under Article 226 of the Constitution of India, the petitioner has questioned the authority with which the sixth respondent has been assigned duty to look after the work of Cashier whereas the petitioner being the Chief Assistant is entitled to take charge of the Cashier on account of the previous Cashier Mr. Narendra Pandey being promoted.

¶3It is submitted that the order dated 03.10.2023 is de hors the circular letter issued by the Chief Engineer, Public Works Department on 22.02.2013.

¶4Learned Standing Counsel submits that matter may be directed to be examined by higher authority.

¶4In my considered view also, petitioner should approach the Engineer-in-Chief raising all his grievances regarding non compliance of the circular with regard to division of work in the department, in first instance, and if he does so within a period of two weeks from today, the second respondent, namely, Engineer-in-Chief, Public Works Department, Government of U.P. at Lucknow shall be passing orders within the next two weeks.
