¶1Heard Sri Kunwar Mayank Singh, learned counsel for the petitioner and Sri Rajesh Kumar Tiwari, learned Additional Chief Standing Counsel appearing on behalf of respondent nos. 1 to 3 as well as Sri Azad Rai, learned counsel for respondent no. 4.

¶2Present petition has been filed seeking a direction in the nature of mandamus to be issued in favour of the respondents to remove the illegal encroachment made over the public utility land bearing plot no.2241, situated at Village Kusumbhi, Tehsil Sadar, District Fatehpur.

¶3Today when the matter has been taken up, learned counsel for Gram Sabha came up with the specific instructions which is taken on record through which it has been transpired that construction of Annapurna Store has been carried out over plot no.2242 which is recorded as navin parti in the revenue record and it has also been apprised through the instructions received by learned Additional Chief Standing Counsel that no construction has been carried over plot no.2241 which is recorded as khalihan in revenue records.

¶4In view thereof, there is hardly any cause of action arises in favour of the petitioner to pursue the instant petition.
