¶1Heard Sri Pramod Kumar Singh, learned counsel for petitioner and learned Standing counsel for State respondents.

¶2Present petition has been filed seeking order or direction in the nature of mandamus, directing respondent no. 2 to initiate proceeding under Section 67 of U.P. Revenue Code, 2006 against respondent no. 3 and 4 with regard to plot no. 183 area 1-2-10 which is recorded as playground situated in village-Semra Mishra, Tappa-Tharauli, Pargana and Tehsil Naugarh, District Siddharth Nagar, within stipulated period as fixed by this Hon'ble Court.

¶3At the very outset, learned Standing counsel came up with specific instructions which is taken on record through which it has been transpired that proceeding under Section 67(1) of U.P. Revenue Code, 2006 against respondent no. 3 and 4 can only be initiated after adjudication of case no. T202317630104754 pending before Sub Divisional Officer, Naugarh and as such no cause of action further survives for petitioner to pursue the instant petition.
