¶1Heard Sri Sunil Kumar, learned counsel for petitioner and learned Standing counsel for State respondents.

¶2Present petition has been filed seeking order or direction in the nature of mandamus directing respondent no. 2 to take appropriate action against respondent no. 5 to 10 for making encroachment over the land in dispute situated as gata no. 333/0.0610 hect. and 332/0.0200 hect. recorded as Nali in village Abdalpur Albela, Tehsil Jalalabad, District Shahjahanpur, in public interest at large.

¶3At the very outset, learned Standing counsel for State respondents came up with specific instructions which is taken on record, through which it has been transpired that at present there is no encroachment over plot no. 333/0.0610 hectare and plot no. 332/0.0200 hectare situated at village Abdalpur Albela, Tehsil Jalalabad, District Shahjahanpur and as such no cause of action survives for petitioner to pursue the instant petition.
