¶1Heard Sri Vikas Tiwari, learned counsel for the petitioner and Sri Krishna Mohan Asthana, learned counsel for the development-Authority.

¶2The petitioner has assailed the show cause notice issued by the respondent-Authority under Section 27 (1) of the U.P. Urban Planning and Development Act, 1973.

¶3Contention of the learned counsel for the petitioner is that construction of the petitioner is in existence since before enforcement of the Act.

¶4Since the impugned notice is in nature of show cause notice, therefore, we find no good ground to interfere with the same and leave it open to the petitioner to submit his defence before the Authority concerned.
