Hon'ble Sanjay Kumar Singh,J. 1-This application under Section 482 Cr.P.C. has been filed by the applicant with a prayer to pass an order directing the court of learned Judicial Magistrate-IV, Allahabad to expedite the hearing of Case No. 687 of 2015 (State Vs. Rata Mishra and others) arising out of Case Crime No. 42 of 2014, under Sections 323, 504, 506, 325 I.P.C., Police Station Manda, District Prayagraj within the time bound frame. 2-At the outset, Mr. Narendra Singh, learned advocate holding brief of Mr. Jay Prakash Patel, learned counsel for the applicant submits that on account of some defect in the application, the applicant does not want to press this application, therefore, he may be allowed to withdraw this application with liberty to file fresh application with better particulars. 3-Learned A.G.A. has no objection to such prayer of the applicant. 4-In view of the above, the instant application is dismissed as not pressed with aforesaid liberty as prayed for. 5-OfÏce is directed to return the certified copy of the documents, if any, to the counsel for the applicant within three days after retaining photocopies of the same on record.
