And 2 Others Counsel for Petitioner :- Swati Singh,Birendra Singh Counsel for Respondent :- C.S.C.,Prateek Kumar Hon'ble Manoj Kumar Gupta,Acting Chief Justice Hon'ble Donadi Ramesh,J.
¶1The petitioners have challenged the award of the Collector dated
06.04.2023 on the ground that their objection with regard to the acquired land being non-agricultural land in character has not been considered.
¶2In our opinion, the petitioners have remedy of challenging the award by seeking reference under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 and, therefore, we find no good ground to examine the factual aspects in exercise of writ jurisdiction.
¶3Accordingly, the writ petition is disposed of with liberty to the petitioner to avail statutory remedy, if so advised. (Donadi Ramesh, J.) (Manoj Kumar Gupta, A.C.J.) Order Date :- 29.11.2023 rkg High Court of Judicature at Allahabad
