¶1Heard learned counsel for the petitioner.

¶2This petition has been filed seeking the following relief: "b) direct the court below to decide the Original Suit No. 823 of 2017 (Smt. Richa Agarwal Vs. Ramawadh @ Sagun) pending in the court of Civil Judge (Junior Division) Court No. 6, period. Gorakhpur within stipulated period."

¶3It appears that the plaintiff-petitioner instituted a suit, being Original Suit No. 823 of 2017 in the court of the Civil Judge (Junior Division), Gorakhpur, seeking a decree of permanent injunction with regard to the immovable property situated in Mauja-Basharatpur, Tappa-Kasba, Pargana-Haveli, Tehsil-Sadar, District-Gorakhpur.

¶4A perusal of the plaint reflects that no plot number is given therein. Learned counsel for the petitioner states that though a written statement has been filed but no issues have been framed. It is stated that the suit is not being proceeded with by the court.

¶5It is open for the petitioner to move an appropriate application before the court concerned for expeditious disposal of the suit. If such an application is filed, the court concerned will consider the same, expeditiously.
