Court No. - 40 Case :- WRIT - C No. - 38393 of 2023 Petitioner :- Sonia Raman Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Manoj Kumar Gautam Counsel for Respondent :- C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J.
¶1Heard learned counsel for the petitioner and Sri Devesh Vikram, learned Additional Chief Standing Counsel for State-respondents.
¶2Present writ petition is filed seeking a writ in the nature of certiorari quashing the impugned expulsion order dated 30.06.2023 passed by the respondent no.5 and 6 and further to direct the respondent no.4 to provide a seat for doing practice in Tehsil Campus Chandpur, District Bijnor.
¶3The petitioner is a practising Advocate in Tehsil Campus Chandpur, District Bijnor. The grievance of the petitioner is that inspite of repeated request, the District Authorities had not accorded any place (chamber) in the Tehsil premises. In this backdrop, by order dated 07.11.2023 we have asked the learned Additional Chief Standing Counsel to seek instructions in the matter.
¶4In response thereof, Sri Devesh Vikram, learned Additional Chief Standing Counsel has placed detailed instructions, which is taken on record. On the strength of averments contained in the said instructions, he submits that the present writ petition is preferred with concealment of material facts, whereas, the petitioner without any right has removed the toilet in the Tehsil and constructed her chamber. The same was resisted by the Bar Association and proceedings had also been initiated against her and thereafter she was expelled for five years, therefore, the writ petition is devoid of merit and liable to be dismissed.
¶5Confronted with this situation, learned counsel for the petitioner prays that the present writ petition may be dismissed as not pressed and leave may be accorded to the petitioner to seek appropriate relief before the appropriate Authority/Forum.
¶6Prayer made is allowed.
¶7Consequently, the writ petition is dismissed as not pressed with the aforesaid leave. Order Date :- 29.11.2023 Manish Himwan High Court of Judicature at Allahabad
