¶1The instant intra-court appeal is directed against the order dated

06.11.2023 by which the learned Single Judge has invited counter affidavit from the respondents and has fixed a date for hearing of the writ petition as a fresh case.

¶2In our considered opinion, the impugned order does not amount to any judgment and order within meaning of Chapter VIII Rule 5 of the Allahabad High Court Rules and the instant intra-court appeal is thus not maintainable.
