Judgment
Court No. - 1 Case :- MATTERS UNDER ARTICLE 227 No. - 9077 of 2023 Petitioner :- Shiv Narain Lal @ Shivnarayan Respondent :- Anil Kumar Gupta Counsel for Petitioner :- Prashant Kumar Bhardwaj,Neetu Singh,Nishant Kumar Hon'ble Jayant Banerji,J. Heard learned counsel for the petitioner. This petition has been filed seeking direction to the Civil Judge (Junior Division), Chandauli to decide Misc. Case No. 4 of 2022 (Anil Kumar Gupta Vs. Shiv Narayan) expeditiously and within a time bound period. The contention of the learned counsel for the petitioner is that an application for deposit of rent was made in the court of Civil Judge (Junior Division), Chandauli by the respondent on his own risk, in which admittedly the rate of rent is Rs. 3000/ per month. It is contended by the learned counsel for the petitioner that Misc. Case was filed on 3.1.2022 which is still pending. This is not a case for interference, inasmuch as Misc. Case that has been filed by the respondent is only for purpose of deposit of rent in the court. In case the petitioner is aggrieved, it is for the petitioner to institute an appropriate proceedings before the competent court. This petition is, therefore, dismissed.
