The applicant has invoked the jurisdiction of this Court under section 482 Cr.P.C. with a prayer to direct the court below to decide the case no. 368 of 2021, Jyoti Pandey Vs. Pawan Upadhyay, under section 125 Cr.P.C., P.S. Sindhora, Varanasi, pending in the court of Additional Principal Judge, Family Court, Court No. 1, Varanasi within the stipulated period. Learned counsel for the applicant has submitted that the applicant is wife of O.P No.2 and she has filed an application under section 125 Cr.P.C for grant of maintenance on 6.3.2021 on the basis of which the present case has been instituted. However, the said case is still pending disposal and has been lingering-on, on one pretext or the other. In view of above, court below is expected to make all endeavour to decide the aforesaid case expeditiously preferably within a period of four months after giving opportunity of hearing to both the sides and without giving unnecessary adjournments to either side and there is no other legal impediment in deciding the aforesaid case.
