Applicants being accused have approached this Court through this application under Section 482 Code of Criminal Procedure seeking quashing of the criminal proceedings of case no.67 of 2002 (State vs. Kanhaiya and others) arising out of Case Crime No.29A of 1995, under Sections 147, 148, 149, 307, 323, 336, 325, 506 I.P.C. and 135, 135(2) Prevention of Public Property Damages Act and Section 27 Arms Act, Police Station-Gyanpur, District Bhadohi, pending in the court of Additional Chief Judicial Magistrate, Ist, Bhadohi. When confronted with the maintainability of the application on the basis of compromise in view of the alleged commission of offences punishable under Section 307 IPC and Arms Act, in view of the decision of the Hon'ble Supreme Court in State of Madhya Pradesh Vs. Laxmi Narayan and others, 2019(5) SCC 688, learned counsel for the accused-applicants does not press this application and prays for withdrawal. This application is dismissed as withdrawn.
