From the record, we find that as per the order dated 31.10.2023 passed in Writ - C No. 33083 of 2023, the petitioner was required to reply within a period of 10 days to the notice under Section 13(2) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (hereinafter referred to as "the SARFAESI Act". The petitioners, it appears, had replied but the communication which was sent was refused by the Bank as is evident from page 52 of the writ petition. Under such circumstances, we provide the petitioner 10 days further time for giving a reply to the notice under Section 13 (2) of the SARFAESI Act. Learned counsel for the Bank has agreed to adjudicate on the reply if the same is served by hand on them within a period of 10 days from today.
