Judgment
Court No. - 6 Case :- WRIT - C No. - 27708 of 2023 Petitioner :- Sultan Niyaji Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Kumar Amit,Aaftab Ahmad Rain Counsel for Respondent :- C.S.C. Hon'ble Mrs. Manju Rani Chauhan,J. List revised. None appears on behalf of the petitioner, however, learned Standing Counsel is present. The order sheet goes to show that learned counsel for the petitioner has not appeared twice, even in revised call. The writ petition has been filed with a prayer to quash the impugned order dated 27.06.2023 passed by District Supply Officer Kanpur Dehat, and further prayer to direct the respondents to decide the appeal along with stay application within stipulated period. Learned Standing Counsel submits that appeal against cancellation of fair price shop license is pending as is evident from page 232 of the writ petition, thus, the relief no.1 cannot be granted, however, he has no objection, if direction is issued to the respondent no.2 to decide the appeal, within stipulated period. No useful purpose would be served by keeping this petition pending in view of the order, which the Court proposes to pass hereunder. In the interest of justice, without entering into merits of the case, this writ petition is finally disposed off with a direction to the respondent no.2 i.e. Commissioner, Kanpur Division, Kanpur, to decide the appeal of the petitioner, pending before him, in accordance with law, after giving opportunity of hearing to the parties concerned, by means of a reasoned and speaking order, preferably within a period of four months, from the date of production of certified copy of this order, if there is no legal impediment. Registrar (Compliance) shall inform about this order to the concerned authorities for necessary information and compliance. Order Date :- 29.11.2023 Rahul. High Court of Judicature at Allahabad
