Judgment

Court No. - 9 Case :- CONTEMPT APPLICATION (CIVIL) No. - 8635 of 2023 Applicant :- Pankaj Devi Opposite Party :- Lalta Prasad, Tehsildar Counsel for Applicant :- Sheelendra Kumar,Sanjay Kumar Singh Hon'ble Rohit Ranjan Agarwal,J. The writ Court on 24.11.2022 in Public Interest Litigation (PIL) No.1892 of 2022 had passed the following order:- "Heard Sri Sheelendra Kumar, holding brief of Sri Sanjay Kumar Singh, learned counsel for the petitioner and Sri Satya Prakash Srivastava, learned Standing Counsel for the State respondents. The present petition has been filed as a public interest litigation seeking to raise a grievance with regard to alleged illegal encroachment by the private respondents over a village 'chak road'. It is not disputed that for redressal of aforesaid grievance, there is a complete procedure prescribed under the Uttar Pradesh Revenue Code, 2006 and in view thereof, this Court is not inclined to entertain the present writ petition. The petition is disposed of leaving it open to the petitioner to avail the appropriate statutory legal remedy. " From the perusal of the aforesaid order, it is clear that the writ Court had declined to entertain the writ petition. In view of the said fact as the writ petition itself was not entertained by the writ Court, present contempt application is misconceived and the same stands dismissed.
