¶1Heard learned counsel for the parties.

¶2After some arguments, counsel for the petitioner confined his prayer only in respect of prayer no.2 in which a mandamus has been sought for to direct the respondent no.1 namely Rent Control & Eviction Officer/ Additional City Magistrate-3rd, Kanpur Nagar to decide application filed under sub-section-5 of Section 16 of the U.P. Act No. 13 of 1972 which is registered as Case No. 01 of 2023 (Renu Harvey @ Anugrahi Abigel Man Singh vs. Moris Dhar and others).

¶3It is argued that the aforesaid application is pending consideration before the respondent no.1 since 20.12.2022 but till date no final decision has been taken.

¶4Heard counsel for the parties and perused the record.

¶5In the facts and circumstances of the case and without interfering the into the merits of the case, the present petition is disposed of finally directing the court concerned to pass appropriate order on the aforesaid application strictly in accordance with law most expeditiously and preferably within a period of six weeks from the date of presentation of certified copy of this order but without granting unnecessary adjournment unless there is no legal impediment.
