¶1Learned A.G.A. for the State submits that instructions have been received and has no objection in case the bail application is heard on merits.

¶2Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.

¶3The present Bail Application has been filed with the prayer to grant bail to the applicant - Munish Kumar @ Mor Mukut in G.S.T. No. 691/2010 arising out of Case Crime No. 39 of 2002, under Section 2/3 of U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police Station - Dadon, District - Aligarh.

Applicant had not participated in the trial court proceedings from the year 2010 to 2023. The explanation offered by learned counsel for the applicant for the absence is that the counsel engaged by the applicant informed that the case has been closed. On a pointed query being made to learned counsel for the applicant whether any complaint was filed against the concerned Advocate for giving false information, learned counsel for the applicant submits that no complaint was filed.

¶5Learned A.G.A. for the State opposed the prayer for bail.

¶6The applicant is absconding for last fourteen years despite the bail granted on 4.6.2002. The absence of the applicant for last fourteen years is without any reasonable cause. Accordingly, the present bail application lacks merit and is dismissed. Order Date :- 30.11.2023 VMA High Court of Judicature at Allahabad
