¶1Heard learned counsel for the applicant, learned A.G.A for the State and perused the record.

¶2Learned counsel for the applicant submits that applicant is mother-in-law of the deceased and she has falsely been implicated in the present case. Learned counsel further submits that the F.I.R. was lodged against the applicant and nine other persons who are her family members. Learned counsel for the applicant further submits that though in the F.I.R. the complainant who is father of the deceased has made allegation against the applicant and her family members including the husband of the deceased for demand of additional dowry in the form of motorcycle and one lakh rupees in cash, and on account of non fulfillment thereof cruelty meted to his daughter and thereafter for killing his daughter by all the accused persons named in the F.I.R., but the complainant in his statement recorded under Section 161 Cr.P.C. has stated that he had lodged the F.I.R. against all the accused persons on hearsay of some persons and now he knew correct facts therefore, he does not want to proceed further against them, thus, learned counsel for the applicant submits that complainant has not supported the prosecution case. Learned counsel for the applicant further submits that as per the postmortem report of the deceased cause of death is asphyxia due to ante mortem hanging. It has also been submitted that except one ligature mark of size 22.0 c.m. x 2.0 c.m. all around the neck no other injury was found on the person of the deceased, which shows that deceased had committed suicide by hanging herself. Thus, it is alleged that no offence as alleged has been committed by the applicant. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned. It has also been assured on behalf of the applicant that she is ready to cooperate with the process of law and shall faithfully make herself available before the court whenever required and is also ready to accept all the conditions which the Court may deem fit to impose upon her. He next submits that applicant is languishing in jail since

08.09.2023, having no criminal history.

¶3Per contra, learned A.G.A. has opposed the prayer for bail of the applicant by contending that the innocence of the applicant cannot be adjudged at pre trial stage, therefore, she does not deserve any indulgence, but he has not disputed that complainant in his statement recorded under Section 161 Cr.P.C. has not supported the prosecution case.

¶4After perusing the record in the light of the submissions made at the bar and after taking an overall view of all the facts and circumstances of this case, the nature of evidence and also the absence of any convincing material to indicate the possibility of tampering with the evidence, without expressing any opinion on merits of the case, this Court is of the view, that the applicant may be enlarged on bail.
