¶1Heard learned counsel for the petitioner and the learned Standing Counsel for the State.

¶2Learned counsel for the petitioner states that the petitioner has filed an application under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 bearing Case No. NIL of 2023 titled as Tata Capital Housing Finance Ltd. v. Gaurav Bhardwaj and another on

11.5.2023. He further states that the aforesaid application is not being decided and, therefore, the petitioner is not able to take possession of the property in question.

¶3Learned Standing Counsel states that the aforesaid application would be decided by respondent No.3-Additional District Magistrate (Finance & Revenue), District Gautam Budh Nagar expeditiously.

¶4Keeping in mind that the petitioner has to recover the loan amount due to the borrowers-respondent Nos.4 and 5, we direct that Case No. NIL of 2023 titled as Tata Capital Housing Finance Ltd. v. Gaurav Bhardwaj and another be decided within a period of one month from the date of production of certified copy of this order.
